August 2022 flood event. Breathitt County is encouraging residents to opt into a Private Property Debris Removal (PPDR) Program.
Breathitt County will be executing this program in partnership with FEMA and the Kentucky Transportation Cabinet (KYTC).
PPDR is a voluntary program intended to remove debris from residential property, and in limited cases, remove debris from commercial properties and provide demolition of damaged structures.

The PPDR program is available to property owners in Breathitt County that have debris remaining from August 2022 flood event. Proof of ownership is required.

As the property owner, your responsibility is to understand, make available, submit and/or execute the required documentation in a timely manner.
These documents include:
Property owners should remove all personal effects from the work area they wish to keep and to prevent possible damages.
Once a property owner registers for the program, a unique identifier will be assigned to the property. Hard copy documentation will be keep in a locked, secure location. Electronic documents will be stored in a cloud-based system that meets security standards. All documents will be redacted as necessary to remove sensitive personal information and only essential employees will have access to the documents.
A ROE allows entry onto your private property for debris removal. A property owner must sign a right of entry (ROE) for debris to be removed from your property in the PPDR program.
A right of entry is completely voluntary, your land is private property and therefore it is your decision to waive the right to grant access.
Ensure you read the ROE in its entirety to understand what you are agreeing to. If you do not fully comprehend your ROE, please come by 1138 Main Street, Jackson, KY, from 10am-7pm M-F starting April 10th, or email PPDRprogram@gmail.com anytime.

Failure to sign an ROE may jeopardize the implementation of a project that could benefit you and/or your community.
In addition to the allowance of entry to private property, the ROW for the PPDR program includes other important language. An ROE form also contains language related to indemnification (liability waiver), debris verification, duplication of benefits and other items.
A right of entry gives legal authority to enter a property owners property.
Access to property may be required for many reasons even before the actual debris removal begins. A few examples of this are access for environmental reviews or site surveys.
Right of entries are legally required for property owners to participate in the PPDR program.
Only one ROE will be required per property for the PPDR program.
Should other state or federally funded projects be initiated in Breathitt County the property owner may be required to sign additional right of entries specific to that program.
Breathitt County will pass along any special request to KYTC and their contracted agents. However, Breathitt County will not guarantee that all special requests can or will be fulfilled.
Duplication of benefits is when a property owner receives money twice for the same expenses.
For example, if you have debris removal coverage in your homeowner insurance policy, those funds will be turned over to KYTC for the debris removal work they performed.
A review of your insurance policy will be part of the program to determine what, if any, duplication of benefits may exist.
This is the case whether you have already been provided the funds and/or already spent these funds. Additionally, if you have debris removal coverage and have not yet received these funds through your insurance carrier, KYTC will request these funds directly from your insurance carrier as part of the program requirements.
Duplication of benefits also applies to other funding sources in addition to insurance, such as FEMA’s Individual Assistance Program, Small Business Association loans, etc.
